4 Sentenced for Drugs, Robbery, R&O, Drug, Property Destruction

John Elza Fetterly of Clare, Michigan, pleaded no contest on Dec. 21, 2021, to Armed Robbery and guilty to habitual 3rd offender. This conviction stemmed from an investigation by the Clare County Sheriff Department into a report of an armed robbery at the Next Door Food Store in Farwell, Michigan, on March 15, 2020. The defendant was ultimately located in Mount Pleasant when he was arrested on a separate matter in the same clothes he was wearing during the armed robbery. Fetterly was sentenced by Judge Roy Mienk on April 19, 2022, to serve a term of prison. He was sentence to serve 4.25 years to 40 years with 186 days credit. He was also ordered to pay $2,998 in assorted fines, costs, and fees.

 Brandon Charles Labuhn of Afton, Michigan, pleaded guilty to Delivery/Manufacture (Cocaine, Heroin, or another Narcotic) less than 50 grams, Possession (Cocaine, Heroin, or another Narcotic) less than 25 grams as a habitual 3rd offender. These convictions stemmed from an investigation conducted by the Clare County Sheriff Department on Oct. 12, 2020. The defendant was sentenced by Judge Mienk on April 19, 2022, to a prison term. He was ordered to serve 13 months to 40 years and 13 months to 8 years respectively, with credit for 69 days already served. He was also ordered to pay $766 in assorted fines, costs, and fees.

 Randolph Keith Simmon of Lake, Michigan, pleaded guilty in two separate files to Resist and Obstruct a Police Office as a habitual 4th offender on Dec. 7, 2021. Both matters stemmed from investigations conducted by the Clare County Sheriff Department. Judge Mienk sentenced the defendant in both files on April 27, 2022, to serve 366 days to 15 years on each count, with no credit for time that he had previously served because he was on parole at the time he committed these crimes. He was ordered to pay a combined total of $396 in assorted fines, costs, and fees.

 Richard Warren Tice of Clare, Michigan, pleaded no contest on Oct. 27, 2021, to Assault with a Dangerous Weapon, Malicious Destruction of Fire and Police Property, as a habitual 4th offender. These convictions stemmed from an investigation conducted by the Clare County Sheriff Department on June 7, 2020. On April 5, 2022, visiting Judge William Ervin sentenced the defendant to serve 14 months to 15 years on each count with credit for 587 days already served. He was also ordered to pay $1,548 in assorted fines, costs, and fees.
